First Legal Shots Fired at Net Neutrality

As expected, emerged challenges to the FCC’s implementation of Net Neutrality regulations via Title II have emerged. Yesterday two petitions were filed in two different federal courts

The trade group US Telecom, which appears to be the chosen vehicle of the big players (AT&T, Verizon et al), filed a petition with the US Court of Appeals in DC, while the Texas-based fixed wireless provider Alamo Broadband made a similar move down in New Orleans.  The two petitioners represent very different factions of the industry, each with its own reasons to protest Title II.

Supposedly, the actions came on Monday as the last of a 10 day period since the rules themselves were posted. But the FCC says the deadline for legal challenges is 60 days after being published int he Federal Register, which hasn’t happened yet — so those pesky initial lawsuits should be dismissed.

And so it begins.

It’ll be years before either dance is complete of course.  In the meantime, net neutrality is here and it’s not going anywhere.  Unless of course someone finds a loophole.

    All the energy that is going into adding more buildings, homes, and cell towers on net, is potentially about to hit a government regulatory wall. And BTW … if I spend millions to build fiber into a new area, and then I am told how to manage it by the FCC, guess what … I will think twice before building. We all understand the concept, but this is not the way.

    The best way to keep things free and open is to regulate the living cr*p out of it. Besides, interwebs access is a right, not a privilege correct? Gotta keep the greedy corporations (that employ thousands of people) from making money. Remember your equations… Profit = bad… Free markets = Dead puppies

      You really are a moron. No one on this board who believes net neutrality is good and that comcast or vz should not be permitted to exact a pound of flesh willy nilly from the content community believes earning a profit is bad.

      Go back and read your Adam Smith.

      The monopoly & oligopoliy they own came from government influence. They earned it the same way Teddy Vail did. If you don’t know who that is look it up.

        BTW, I’m more of a Murray Rothbard guy although Bastiat has his merits.

    Net neutrality is really important for India like developing country. Please support net neutrality.
